JCT Clause 6.5.1 Indemnity Non-Negligent Insurance

Working on a construction project with neighbouring properties comes with the risk of causing damage to them, even if unintentional. Under a minor works JCT contract you may be requested to purchase 6.5.1 insurance cover, which would offer protection for these instances. Cover is in respect of legal liability for expenses, liability, loss, claims or proceedings that arise due to non-negligent injury or damage to any property while undertaking a building contract.

Risks Covered under a 6.5.1 Insurance:

  • Collapse
  • Subsidence
  • Heave
  • Vibration
  • Weakening or removal of support
  • Lowering of ground water

Cover would always be in the joint name of Contractor and their Employer (as defined in the contract).
